EKOM UG, Hochfeldweg 42, 89555 Steinheim am Albuch (hereinafter referred to as “the Provider”) offers online courses on this website in the form of HTML content on a protected website and PDF documents for tradespeople and the self-employed for purchase via the Internet.

The following General Terms and Conditions apply to all contracts, deliveries and other services. The provider hereby expressly objects to any deviating provisions of the contractual partner. All ancillary agreements require the written confirmation of the supplier.

The Provider is entitled to amend or supplement these General Terms and Conditions, including any annexes, at any time with a reasonable period of notice.

2. order, delivery and payment

When ordering an online course, delivery is made by electronic transmission. There is no physical delivery. The provider only accepts the payment methods displayed to the buyer during the ordering process.

3. delivery times

Delivery will be made electronically immediately after receipt or completion of payment.

4. prices, price changes

The prices stated at the time of the order shall be decisive for invoicing. All prices are inclusive of VAT (unless otherwise stated). There are no further product-related costs (e.g. shipping costs). Any costs for the transfer of money (in particular for transfers from non-EU countries) shall be borne by the buyer(s).

5. revocation instruction

The provider expressly points out that according to § 312d BGB paragraph 4 No. 1 digital goods are excluded from the right of withdrawal due to the special nature and impossibility of return.

6 Terms of use for the online course and for PDFs and e-books, copyright

When purchasing an online product, the provider grants the buyer the simple and non-transferable right of use for personal and sole use. Any distribution, duplication or commercial use of the files or parts thereof is not permitted. The buyer is only entitled to make copies for backup purposes. Any other type of reproduction is prohibited. The buyer is not entitled to resell the purchased content or dispose of it in any other way. This also applies to posting on websites, internet forums and blogs.
The provider reserves the right to update the versions. These updates are subject to the same right of use as the originally purchased version of the course.
The copyright as well as all copyrights to the files offered via www.ekom7.com and the websites of www.ekom7.com belong to the provider. Violations of the terms of use and copyright will be prosecuted under civil and criminal law.
If the buyer wants to use the course together with others (e.g. in a work team), he or she can contact the provider, who will then prepare a personal offer for several licenses.

7. disclaimer

>The online course is tested in the latest browser versions (Mozilla Firefox, Google Chrome, Safari and Internet Explorer). The provider does not guarantee the functionality of this course and the software recommended therein with other (older) browsers.
Parts of the content are offered in the form of PDF files. The provider is not liable for errors or loss of data on the system of the buyer(s) due to incompatibility with PDF technology. The buyer shall ensure that it uses a system or software suitable for this purpose.
The provider expressly points out that all information in the online course, on the website and in the associated e-mail newsletters is provided without guarantee of completeness or accuracy. This information is for general guidance only and cannot replace legal advice. The provider therefore accepts no liability for damages that may arise in connection with the use of this information. Liability claims for material or non-material damage caused by the use of these pages and the online course are therefore excluded.

Questions about the course itself, how it works or the purchase process can be sent directly to the provider by e-mail before purchase.
For further questions on website design, content creation or specific implementation, participants in the online course can take part in a free weekly “consultation hour” – an online, text-based chat in which the provider answers these questions.
Important: If there are a large number of consultation hour participants and/or complex questions, it may not be possible to answer the question during the consultation hour. In this case, it is possible to clarify the open issues in a separately bookable, fee-based individual consultation.
Support services for the individual services recommended by the provider on this website and in the online course are not provided by the provider. These questions can be put to the respective providers of these services.

9 Choice of law and place of jurisdiction

The law of the Federal Republic of Germany expressly applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The contract language is German.
The exclusive place of jurisdiction for contracts with merchants, legal entities under public law or special funds under public law is the court responsible for the registered office of the provider.

10. severability clause

Should individual provisions be or become invalid in whole or in part, or should the contract contain a loophole, this shall not affect the validity of the remaining provisions. The invalid or missing provisions shall be replaced by the respective statutory provisions.
